These Terms constitute a legally binding agreement between you and the Service and govern your access to and use of the platform, including any content, functionality, and services offered through the website.

1. Key Terminology

For purposes of these Terms:

  • “Service,” “we,” “us,” or “our” refers to https://human-academics.com and the entity that owns and operates it.
  • “User,” “Client,” or “you” refers to any individual or entity that accesses, registers with, or otherwise uses the Service.
  • “Educator” refers to an independent professional who provides learning guidance, educational support, or subject-matter assistance through the Service in response to User requests.
  • “Terms” refers to these Terms of Service, as amended from time to time.

2. Platform Overview

The Service is an online educational support platform that connects learners with qualified Educators across various academic and professional subject areas. The Service facilitates the submission of user requests for learning support and provides access to guidance, explanations, study materials, and other educational resources intended to assist Users in developing their knowledge and skills.

The Service operates as a technology platform and intermediary. It does not provide accredited educational instruction, confer academic credit, or grant degrees. Educators provide independent learning support services in response to User requests. Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between the Service and any Educator.

The Service is intended solely for lawful educational support purposes. Users are responsible for ensuring that their use of the platform complies with all applicable federal, state, and local laws and institutional policies, including but not limited to laws governing academic integrity and consumer protection.

3. User Responsibilities

By accessing or using the Service, Users agree to the following obligations:

  • Use the platform solely for legitimate educational support purposes, including enhancing knowledge, developing skills, and improving understanding of academic or professional subject matter.
  • Provide accurate, complete, and sufficiently detailed information when submitting a request for learning support to enable Educators to deliver appropriate guidance.
  • Refrain from submitting any request that could reasonably be interpreted as facilitating academic dishonesty, fraud, misrepresentation, or any other violation of applicable law or institutional integrity policies.
  • Use all materials, explanations, and guidance provided through the Service in a manner consistent with their educational institution’s rules, codes of conduct, and academic integrity policies.
  • Interact respectfully and professionally with Educators and avoid harassment, discrimination, abusive conduct, or unlawful communications, consistent with applicable federal and state anti-discrimination laws, including but not limited to Title VI and Title IX where applicable.

Users are solely responsible for how they apply or rely upon any educational support provided through the Service.

4. Academic Support Services

4.1. Scope of Services

The Service provides educational guidance and learning support through independent Educators in response to User requests. Services may include explanations, study strategies, conceptual clarification, feedback, and other study support tools designed to assist Users in developing their own understanding and competencies.

The Service does not complete coursework on behalf of Users, sit for examinations, or represent Users in academic or professional evaluations. Users are responsible for ensuring that their use of the Service complies with their institution’s integrity standards and all applicable federal, state, and local laws.

4.2. Educational Support Provision Methods

Users may access learning support through the following communication channels:

  • SMS messaging using the designated contact number;
  • Email correspondence;

The Service takes reasonable administrative, technical, and physical safeguards to protect User information and materials, consistent with applicable U.S. privacy and data protection laws, including, where applicable, the California Consumer Privacy Act (CCPA) and other relevant state data protection statutes. While the Service strives to provide secure support, no method of electronic transmission or storage is guaranteed to be completely safe.

5. Protection of Intellectual Assets

5.1. Ownership of Educational Materials

Unless expressly provided otherwise in a separate written agreement signed by an authorized representative of the Service, all educational resources, study materials, explanations, templates, guides, and other content developed, adapted, or provided by Educators through the platform in response to a User request are and shall remain the exclusive property of the Service and/or its licensors.

Subject to full compliance with these Terms, the Service grants the User a limited, revocable, non-transferable, non-sublicensable, and non-exclusive license to access and use such materials solely for the User’s personal, non-commercial educational purposes.

All materials are protected under applicable United States intellectual property laws, including the U.S. Copyright Act (17 U.S.C. § 101 et seq.), as well as applicable state and international intellectual property laws.

5.2. Permitted and Prohibited Activities

Users may:

  • Access, review, and learn from educational content provided through the Service for personal educational development.
  • Engage with Educators to improve skills, clarify concepts, and deepen subject-matter understanding in response to a submitted request.

Users may not:

  • Represent collaboratively developed materials as solely their own original work where doing so would violate applicable academic integrity policies or laws.
  • Reproduce, distribute, publicly display, publish, transmit, sell, license, or otherwise disseminate any materials obtained through the Service without prior written authorization.
  • Use any materials for commercial gain, resale, publication, or competitive purposes without the Service’s express written consent.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices.

5.3. Repercussions for Intellectual Property Infringement

Unauthorized use, reproduction, or distribution of proprietary materials may result in:

  • Immediate suspension or termination of access to the Service;
  • Civil action for copyright infringement or other intellectual property violations under applicable federal and state law;
  • Disclosure of relevant information to academic institutions or other appropriate authorities where required by law, court order, or valid legal process.

The Service reserves all rights not expressly granted in these Terms.

6. User Age Criteria

6.1. Age Restrictions for Access

The Service is intended for individuals who are at least eighteen (18) years of age. By accessing or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract under applicable U.S. law.

Individuals under the age of 18 are not permitted to register for or use the Service.

6.2. Compliance with Data Protection Regulations

The Service complies with applicable U.S. privacy and data protection laws, including, where applicable, the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506.

The Service does not knowingly collect, use, or disclose personal information from children under the age of 13. If we become aware that personal information has been collected from a child under 13 without verifiable parental consent, we will promptly:

  • Delete the relevant personal information from our records; and
  • Terminate or restrict the associated account, as appropriate.

For Users between the ages of 13 and 17, access to the Service may be restricted or require appropriate authorization where mandated by applicable law.

6.3. Parental Responsibility

Parents and legal guardians are responsible for monitoring and supervising minors’ online activities. The Service encourages parents and guardians to take appropriate steps to ensure that minors do not access the platform in violation of these Terms.

6.4. Unauthorized Underage Access

If you believe that a minor has accessed or is using the Service in violation of this Section, please contact [email protected] so that appropriate corrective action may be taken.

7. Payment and Pricing

7.1. Accepted Payment Methods

The Service accepts secure electronic payments through the following methods, as available at the time of transaction:

  • Major credit and debit cards, including MasterCard and Discover;
  • PayPal;
  • Bank wire transfers, where expressly authorized by the Service.

All payments are processed through third-party payment processors in compliance with applicable U.S. financial regulations and industry standards, including the Payment Card Industry Data Security Standard (PCI DSS). The Service does not store complete payment card information.

7.2. Payment Terms

Full payment is required in advance of the commencement of any learning support services. No Educator will begin work on a User’s request until payment has been successfully authorized and confirmed.

Service fees are determined based on the complexity of the request, the scope of support required, the subject matter, and the anticipated time necessary to provide guidance. Pricing details will be presented to the User prior to confirmation of the request.

Failure to remit payment when due may result in suspension, cancellation, or refusal of service.

7.3. Transparent Fee Structure

The Service provides clear, upfront pricing quotes before a User confirms a request. No hidden fees will be added after confirmation. An 11% service fee will be automatically included in the price.

If changes to a request materially affect its scope or complexity, the Service will issue a revised quote. Any adjustment in price requires the User’s explicit approval before additional services are provided.

All pricing practices are intended to comply with applicable federal and state consumer protection laws, including laws prohibiting unfair or deceptive acts or practices.

7.4. Pricing Currency

All prices are listed and charged in United States Dollars (USD), unless otherwise expressly stated. Users are responsible for any currency conversion costs, foreign exchange charges, or banking fees imposed by their financial institution or payment provider.

Applicable federal, state, or local taxes, including sales or similar transaction-based taxes, may be applied where required by law. Users are responsible for any such taxes associated with their purchase.

7.5. Billing Documentation

Electronic receipts and invoices will be sent to the email address associated with the User’s account upon successful payment.

Corporate or institutional Users may request customized billing documentation, subject to reasonable verification and processing requirements.

8. Refund Policy

8.1. Eligibility

Refunds may be granted at the Service’s reasonable discretion under the following circumstances:

  • The educational guidance materially fails to meet the agreed-upon specifications of the confirmed request;
  • The agreed delivery timeline is exceeded without a prior, mutually approved extension;
  • A verified technical error results in duplicate charges, incorrect billing, or other payment processing issues.

Refunds will not be issued where dissatisfaction arises from factors outside the original scope of the request or from the User’s misuse of the provided materials.

This Refund Policy is intended to comply with applicable U.S. consumer protection laws, including federal and state laws governing unfair or deceptive acts or practices.

8.2. Refund Request Process

Refund requests must be submitted within ten (10) business days following completion of the relevant collaboration or the occurrence of the issue giving rise to the request.

To initiate a refund request, Users must contact [email protected] and provide:

  • The order or transaction reference number;
  • A detailed explanation of the issue;
  • Any supporting documentation or evidence.

Failure to provide sufficient information may delay review or result in denial of the request.

8.3. Refund Assessment and Dispute

All refund requests are reviewed by the Service’s Quality Control team in a timely and commercially reasonable manner.

If a refund is approved, the amount will be credited to the original payment method within seven (7) to ten (10) business days, subject to the processing times of the applicable financial institution.

If a User disputes a refund determination, the matter may be escalated by submitting a written request with “Escalation Request” in the subject line. The Service will conduct an additional internal review.

9. Modifications to Terms

The Service reserves the right to revise or update these Terms at any time to:

  • Comply with applicable federal, state, or local laws and regulations;
  • Address technical, operational, or security requirements;
  • Reflect changes to services, features, or business practices.

Material changes will be communicated by updating the “Effective Date” and posting a notice on the homepage or within the platform. Continued use of the Service after the Effective Date constitutes acceptance of the revised Terms.

If a User does not agree to the updated Terms, the User must discontinue use of the Service.

10. Third-Party Service Integration

The Service may engage trusted third-party providers to support essential functions, including communications, data hosting, payment processing, analytics, and security.

Such providers are contractually required to process personal information solely for operational purposes and in compliance with applicable U.S. privacy and data protection laws, including, where applicable, the California Consumer Privacy Act (CCPA) and other relevant state privacy statutes.

User information is shared only to the extent reasonably necessary to provide and maintain the Service, fulfill legal obligations, or enforce these Terms.

11. Legal Framework and Dispute Management

These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the State designated in the Service’s governing entity registration, without regard to conflict of law principles.

Users agree to first contact the Service at [email protected] to attempt informal resolution of any dispute.

Where informal resolution is unsuccessful, disputes may be resolved through:

  • A small claims court of competent jurisdiction, where applicable; or
  • Alternative dispute resolution (ADR), such as mediation or binding arbitration, if required by a separate written agreement or applicable law.

Nothing in this Section limits either party’s right to seek relief in a court of competent jurisdiction where legally permitted.

12. Venue for Legal Proceedings

Unless otherwise required by applicable law, any legal action or proceeding arising out of or relating to these Terms shall be brought in a state or federal court of competent jurisdiction located in the state in which the Service’s governing entity is registered.

By using the Service, Users consent to the personal jurisdiction of such courts and waive any objections based on improper venue or forum non conveniens, to the extent permitted by law.
